1. General

1.1. Welcome to SilverCrest Finance (hereinafter referred to as the “Website”).

1.2. The Website provides information about third-party platforms (hereinafter referred to as “Third-Party Platforms”) that enable digital asset trading and investment activities (hereinafter referred to as the “Services”).

1.3. These Terms and Conditions (hereinafter referred to as the “Terms”) govern your (“You”, “Your”, or “User”) use of the Website and the related Services. We encourage you to read these Terms carefully before using the Services. By accessing or using the Website, you agree to be bound by these Terms, which constitute a legally binding agreement between you and the operator of the Website. 2. Eligibility

2.1. You may use the Website only if you meet all of the following criteria:

2.1.1. You are at least 18 years old;

2.1.2. You have the legal right, authority, and capacity to enter into this agreement and comply with all its terms and conditions;

2.1.3. You are not prohibited under the laws of Kuwait or any other applicable jurisdiction from accessing or using the Website and/or the Services.

2.2. SilverCrest Finance makes no representations or warranties, express or implied, regarding the legality of the Website and/or the Services or the way in which any individual may use them. We assume no responsibility for any unauthorized use of the Website and/or the Services.

3. Restricted Territories

3.1. In addition, SilverCrest Finance reserves the right, at its sole discretion, to restrict access to the Website and/or the Services (or any part thereof) for: (i) users located in certain jurisdictions (hereinafter referred to as “Restricted Territories”), and (ii) individuals whom we reasonably believe may expose us to legal, regulatory, reputational, or financial risk.

3.2. We may impose additional requirements or conditions before accepting users residing in or accessing the Website from specific countries. If a user travels to a Restricted Territory, access to the Website and/or the Services may be limited or blocked.

4. Prohibited Activities

4.1.1. 4.1.2. Removing or altering any legal notices or proprietary designations on the Website;

4.1.3. Accessing the Services through any interface other than the Website;

4.1.4. Interfering with the experience of other users of the Website and/or the Services;

4.1.5. Using bots, automated systems, or similar technologies to interact with the Website and/or the Services;

4.1.6. Uploading or transmitting (or attempting to upload or transmit), without our consent, any material that contains hidden data collection or tracking mechanisms (such as web bugs, cookies, spyware, or similar technologies);

4.1.7. Engaging in “framing,” “mirroring,” or any other unauthorized copying of the appearance or functionality of the Services;

4.1.8. Violating any applicable laws or encouraging unlawful activity, including but not limited to copyright infringement, trademark violations, defamation, identity theft, hacking, or distribution of illegal software;

4.1.9. Modifying or interfering with the source code of the Website or uploading software that may damage the Website or third parties;

4.1.10. Decompiling, disassembling, or reverse engineering any software or technology used on the Website or within the Services.

4.2. You acknowledge that if we believe you are using the Website or the Services in violation of these Terms or applicable law, we may monitor your activity, restrict your access, share relevant information with third parties, and take any action we deem necessary to protect our rights and the rights and interests of third parties.

5. Intellectual Property Rights

5.1. The entire Website, including all content such as videos, text, images, logos, designs, graphics, music, sounds, trademarks, and other materials, is protected by intellectual property rights owned by us or by third parties.

5.2. We retain all rights, title, and interest in and to the Website and the Services. Your use of the Website or the Services does not grant you any intellectual property rights other than the limited right to use the Website in accordance with these Terms.

5.3. Users may use the Website and the Services solely for personal, non-commercial purposes.

5.4. Users are strictly prohibited from modifying, decompiling, disassembling, reverse engineering, copying, transferring, creating derivative works from, renting, sublicensing, distributing, reproducing, republishing, scraping, downloading, displaying, transmitting, publishing, selling, or otherwise exploiting any content from the Website without our prior written consent. Under no circumstances shall we be liable for any special, direct, indirect, incidental, punitive, or consequential damages, including loss of profits or data, arising out of your use of the Website and/or the Services or any materials downloaded from the Website. This applies regardless of the legal theory invoked and even if we have been advised of the possibility of such damages. If a court of competent jurisdiction finds us liable, our total liability shall not exceed 100 USD or the equivalent amount in Kuwaiti Dinar (KWD). This limitation applies to the maximum extent permitted by law.

6.5. We are not responsible for any technical problems or malfunctions of telephone lines, network systems, computer systems, servers, providers, hardware, software, or for congestion on the Internet, or incompatibility between the Website/Services and your browser or equipment. We disclaim all liability related to your use of the Internet.

7.1. When using the Services, you may encounter content or services provided by third parties, such as advertisements or reviews related to Third-Party Platforms.

7.2. We do not control, endorse, or assume responsibility for such content or services, and they may be inaccurate or outdated.

9. Miscellaneous

9.1. We may, at our sole discretion, modify, suspend, or discontinue any part of the Services or introduce new Services at any time. We shall not be liable for any loss you may incur as a result of such changes, and you shall have no claims against SilverCrest Finance in this regard.

9.2. We reserve the right to update these Terms from time to time. When updates occur, we will publish the latest version on the Website. The changes become effective immediately upon publication. By continuing to use the Website after such updates, you agree to the revised Terms.

9.3. The User acknowledges that the transmission of information to or from the Website does not create any relationship beyond those specified in these Terms.

9.4. These Terms and the Privacy Policy, as amended from time to time, constitute the entire agreement between SilverCrest Finance and the User. No other promises, representations, or agreements, whether oral or written, shall be legally binding.

9.5. Any failure by us to enforce a right, power, or remedy shall not constitute a waiver of that right or any other right. Partial enforcement of any right shall not prevent further enforcement of that or any other right.

9.6. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed without affecting the validity of the remaining provisions. The Terms shall be interpreted to best reflect the original intent of the provision, to the fullest extent permitted by law.

9.7. We reserve the right to assign or transfer all our rights and obligations under these Terms to any third party. The Website and/or the Services may also be operated by a third party. You may not assign, transfer, or pledge any of your rights or obligations under these Terms in any manner.
